Americans With Disabilities Act (ADA) Written Grievance Procedure

This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act (ADA).  It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs or benefits offered by the Village of Sheffield.

The complaint should be in writing and contain information regarding the alleged discrimination as well as the specific location of the alleged violation.  The complaint should contain the name, address and phone number of the individual initiating the complaint, and the location, date and description of the problem. Alternative formats for filing a grievance, such as personal interviews or tape recordings, will be available upon request for persons with disabilities.

The complaint should be submitted by the complainant or designee as soon as possible, but no later than 60 days following the incident to Ken Kaczay, ADA Coordinator’s Office at 4480 Colorado Avenue, Sheffield Village OH  44054,  kenk@sheffieldvillage.com or 440.949.6209.

Within 15 calendar days after receipt of the complaint, the ADA Coordinator will meet with the complainant or designee to discuss the issue and possible resolutions.  Within 15 calendar days of the meeting, the ADA Coordinator will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, Braille, or audio tape.  The response will explain the position of the Village of Sheffield and offer options for substantive resolution of the complaint.

If the response by the ADA Coordinator does not satisfactorily resolve the issue, the complainant or designee may appeal the decision to the Sheffield Village Mayor within 15 calendar days after receipt of the response.

Within 15 calendar days after receipt of the appeal, the Sheffield Village Mayor will meet with the complainant or designee to discuss the complaint and possible resolutions.  Within 15 calendar days after the meeting, the Sheffield Village Mayor will respond in writing and, where appropriate, in a format accessible to the complainant with a final resolution of the complaint.

All written complaints received by the ADA Coordinator, all appeals to the Sheffield Village Mayor and responses from those offices will be retained by the Village of Sheffield OH for at least three (3) years.
